Vietnam's Ministry of Construction Calls for Accountability in Nha Trang City Projects

(NewsNibs) - The Ministry of Construction has tasked the People's Committee of Khanh Hoa Province with investigating and addressing the accountability of individuals and organizations involved in projects not aligned with Nha Trang City's master plan, sanctioned by the Prime Minister in 2012. Concerns were raised after a document was circulated last month asking for additional details regarding the adjustments intended for the Nha Trang City Master Plan Project, envisioned up to 2040 (QHC 2040). The ministry emphasized the need for a thorough review and supplementation of new contents to ensure a solid assessment basis before escalating the planning project for the Prime Minister's consideration.
Detailed Project Assessment
Included in the QHC 2040 documentation is the careful assessment of 42 projects based on the Prime Minister's decree from September 2020 as well as March and April 2023 communications from the Ministry of Construction. These projects are categorized into four groups. The first group comprises 24 projects, which received their location agreements and investment licenses before the Prime Minister's decision in September 2012 and remain undefined in the previously approved QHC 2012. Group two contains 16 projects approved after this benchmark. One notable project in Group three was featured in QHC 2012 but is being considered for removal in QHC 2040. The final group includes a single project added to the plan according to a Government Inspectorate conclusion.
Need for Clarity and Legal Compliance
The Ministry has flagged the provincial report for lacking explicit criteria necessary for determining the continuity of detailed plans, projects, and solutions for those needing cessation. What's more, the criteria for legal evaluation, legal measures, and responsibilities associated with violations along with rectifying solutions should these projects align with QHC 2040 are not delineated. Specific instructions from the ministry mandate that Khanh Hoa Province must deliver a comprehensive report, analyzing projects based on the Prime Minister's requests and Ministry's recent directives. Reviews are to establish a solid base, considering political, scientific, legal, infrastructural, societal, and environmental aspects, in deciding whether projects incongruent with QHC 2012 will persist in the new master plan.
The People's Committee of Khanh Hoa Province is also required to clearly define the parameters, such as scale, boundaries, and functional requirements for these projects, ensuring they meet the QHC 2040's standards. Furthermore, determining the responsibilities of entities and individuals for the non-conforming projects is vital, with subsequent actions to be taken in alignment with urban planning, land, and housing regulations.
