Harare Man Seeks Court's Aid in Family Estate Dispute

Mtitima has initiated legal proceedings at the Harare Civil Court against Nicholas Chazika, accusing him of causing disturbances and behaving violently at his house. The conflict stems from a claim by Chazika that the property in question was bequeathed to him by his grandmother, who is also Mtitima's great-aunt. Mtitima alleges that this familial discord has led to an incident where Chazika assaulted his child and sister. Further complicating the matter, Chazika is reported to be currently out on bail for a separate case of violence at Mbare Court.
Contentious Claims
The heart of the dispute lies in the inheritance of the house, with Chazika insisting that the property rightfully belongs to him as it was left to his mother, and consequently to him and his siblings, upon their grandmother's demise. Despite these claims, Mtitima questions why his cousins, who own a property in Chihota, are insistent on acquiring his residence. According to Mtitima, the matter of the estate is currently unresolved and under the purview of the Master of High Court, and he plans to vacate once it is settled. Moreover, Mtitima states he possesses video evidence supporting his accusations of Chazika's violent conduct at his home.

In a turn of events, Chazika has rebutted Mtitima's claims, asserting that the legal action is a strategy to block him from accessing his birth home. Chazika further alleges a conspiracy between Mtitima and the local community on Gwatidzo Street, aiming to injure or expel him should he visit the street where the house is situated. Chazika also points out that Mtitima owns another property, from which he collects rent, and suggests that Mtitima could reside there instead. However, Judge Sharon Mashavira has ruled in favor of Mtitima by granting him a protection order amidst the legal and familial contention.
