Innocent Mtitima, a resident of Harare, has brought his cousin, Nicholus Chazika, to Harare Civil Court, amidst allegations of harassment and eviction attempts. Mtitima asserts that Chazika frequently creates disturbances at his home, challenging his right to reside there. The contention has escalated to legal action as family ties strain under the gravity of the dispute.
Claims of Assault and Evidence
An extreme incident brought forward by Mtitima details an alleged assault by Chazika against Mtitima’s child and sister. This assault case is reportedly being processed at the Mbare Court. To strengthen his claims, Mtitima states he possesses video evidence documenting Chazika's violent behavior within his home. The evidence's credibility and influence on the case remain subject to the court's scrutiny.
Accusations of Conspiracy and Property Ownership
Counter accusations have surfaced as Chazika alleges Mtitima is conspiring with locals to restrict his access to the contested property, situated at 40 Gwatidzo Street. Further complicating the dispute are claims that the house legally belongs to Chazika and his siblings, supposedly willed to them by their grandmother, thus challenging Mtitima's occupancy. Meanwhile, Mtitima holds another property, which he rents out and is said to belong to his father, indicating the presence of multiple family assets at the heart of their disagreements. The inheritance's legal determination is yet to be concluded by the Master of High Court.
Protective Order Issued
Amidst the familial turmoil, Judge Sharon Mashavira has issued a protective order in favor of Innocent Mtitima. The order stands as a temporary measure aimed to prevent further disturbances as the court case progresses. This decision highlights the judiciary's role in upholding personal security amidst ongoing property and inheritance conflicts.
